In pursuance of the power conferred by clause (a) of Sub-Section (1) of Section 9 of the Indian Stamp Act, 1899 (2 of 1899) and since the Governor is of the opinion that there are reasonable grounds for doing so, by Sub-Section (2) of Section 78 of the Registration Act,1908 (16 of 1908), the Governor is pleased hereby to remit the Stamp duty and registration fees chargeable on the amount of difference, if any, between the market value of such property and the value set forth in the deed of transfer thereof as the State Government or any undertaking of the State Government may transfer on sale/settlement/long term lease/lease in perpetuity for a fine for a fine or premium or for money advanced in addition to the rent, if any, reserved on any assignment on specific condition that such property shall not be transferred without the prior permission of the State Government or the authority of the State Government or the undertakings of the State Government, as the case may be.

2. The Governor is further pleased to order that such remission of Stamp duty and registration fees shall not be allowed in any subsequent transfer of the property as aforesaid to any other person by the original transferee even when it is done with the prior permission of the State Government or the authority of the State Government or the undertaking of the State Government, as the case may be.

Government of West Bengal has taken up a Land Purchase Scheme “Chash-O-B Basobaser Bhumidan Prakalpa­ a State Project” for free distribution of agricultural land to landless and Homesteadless Rural Families.

WHEREAS, the Governor is of the opinion that there are reasonable ground for doing so;

NOW, THEREFORE in exercise of the power conferred by clause (a) of sub-clause (I ) of section 9 of the Indian Stamp Act. 1899 (2 of 1899) and by sub-section (2) of section 78 of the Registration Act, 1908, the Governor is Pleased hereby to remit the Stamp Duty and Registration Fees Chargeable under the aforesaid Acts on the execution of a decd of departmental purchase of land for distribution to the landless and homesteadless under “Chash-O-B Basobaser Bhumidan Prakalpa­ (State Project)”.

NOW THEREAFTER, in exercise of the power conferred by sub – section (2) of the Section 78 of the Registration Act, 1908 (16 of 1908) the Governor is pleased hereby to remit, in the whole of West Bengal, the fees payable for registration of documents to be executed by the fish farmers for obtaining loans for development of ponds and cost of inputs for improvement of fisheries from any of the following institutions, namely –

  1. State Bank ofIndiaand its subsidiaries,
  2. Nationalized Banks
  3. Commercial Banks other than those mentioned against (1) & (2)  above,
  4. Co-operative Banks other than Loan Development Banks,
  5. Regional Rural Banks,

Now, THEREFORE, in exercise of the power conferred by sub-section (2) of section 78 of the Registration Act, 1908 (16 of 1908) (hereinafter referred to as the said Act), the Governor is pleased hereby to remit –

(a)  Fifty per centum  of registration fees payable under the said Act, in the case of any new unit as defined in clause (xi) of paragraph 3 of the West Bengal Incentive Scheme, 2000,

(b)  Hundred per centum of registration fees payable under the said Act, in the case of any eligible unit as defined in clause (xvii) of paragraph 3 of the West Bengal Incentive Scheme, 2000,

In respect of instrument of purchase or acquisition of land and buildings for setting up of an approved project irrespective of location of the said project within the State, subject to the condition that such new unit or eligible unit, as the case may be, does not opt for the West Bengal Incentive Scheme, 2004, where such new unit or eligible unit, as the case may be, has been registered and sanctioned incentives under the West Bengal Incentives Scheme, 2000, in terms of provisions contained in para 5.1 of the West Bengal Incentive Scheme, 2004, or where such new unit or eligible unit, as the case may be, has applied for registration with the Directorate of Industries, or the Directorate of Cottage and Small Scale Industries or the Directorate of Tourism, as the case may be, under the West Bengal Incentive Scheme, 2000, but such applications have not been disposed of prior to the coming into effect of the West Bengal Incentive Scheme, 2004, as provided in para 23.1 of the said West Bengal Incentive Scheme, 2004,

2. This order shall come into force with immediate effect.
